About family mediation
The vast majority of family law disputes are settled out of Court. For over 20 years, family law mediators have assisted families in resolving disputes outside the costly and time consuming litigation process.
Parties who submit their dispute to a Judge for a decision give up control of their dispute and effectively place it in the hands of another person. Mediated settlements, on the other hand, are often more easily accepted by each party as they have worked collectively on the outcome and maintained some control over the process and the resolution.
There's another advantage unique to mediated, as opposed to Court ordered settlements, where children are involved. Mediation can help develop a communication protocol for separating parents and can also assist them in developing workable relationships that extend beyond a divorce or separation.
The extent to which lawyers are present at a family law mediation will vary, however, each party will require independent legal advice at some point in the process.
